A BILL to amend article three, chapter seventeen-b of the code of
West Virginia, one thousand nine hundred thirty-one, as amended,
by adding thereto a new section, designated section three-d,
relating to suspension of driver's license as additional penalty
for vandalism of public property.
Be it enacted by the Legislature of West Virginia:
That article three, chapter seventeen-b of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
three-d, to read as follows:
ARTICLE 3. CANCELLATION, SUSPENSION OR REVOCATION OF LICENSES.
§17B-3-3d. Suspending resident's license upon conviction of
vandalism.
The department is authorized to suspend or revoke the license of any resident of this state upon receiving notice of
the conviction of that person for the offense of vandalism or
intentional theft, destruction or obliteration of defacement of
highway signs, directions or other structures, including school
bus structures, or property of any county board of education or
other public property. Upon conviction of this offense, in
addition to any fine or sentence or reparation, or requirement
that the property destroyed or vandalized be replaced, repaired
or renovated, the driver's license of the person so convicted
shall be suspended for a period not to exceed six months or until
the fine or reparation has been fully paid.
NOTE: The purpose of this bill is to add the suspension of
driver's license as a penalty for vandalism of public property.
§17B-3-3d is new; therefore, strike-throughs and
